1.3 How to Identify a UBO in InScope when a Trust is involved

If the environment is configured to specify Settlors or Beneficiaries as being UBOs (which is the case for most environments) then a Settlor of a Trust that owns a company is considered to be a UBO of that company.

However, if this is not the case, please see below:

In order to easily add and report on such UBOs, users will need to add the UBO as a ‘Controller’.

it is important for users to note that the individual deemed to be a UBO should be added as a ‘Controller’ of the company they are the UBO of, not the Shareholding trust.

Users will then be asked to input the details for the UBO. If they are already created in the system, then the last name will suffice in order to search for them.

If the individual is not previously in the system users will be taken to the Individual profile creation page.

As long as ‘Controllers’ are considered UBO’s in the system configuration, this Individual will now show up as a UBO for reporting purposes.

Also note:

If a Trust owns multiple companies and users wish to add the individual as a UBO to all companies owned, adding the Individual as a Controller at the Trust level would also work

N.B. If users are unsure whether Controllers are counted as UBO’s this can be confirmed via risk settings in the settings menu, our help document here or users can contact support@inscope-aml.com for further assistance.
